1. Definitions

2. Scope of Services

2.2 Our Services typically include loading of waste onto our vehicle, transport from the Premises, and transfer of such waste to an authorised waste facility for disposal, recycling or recovery, in accordance with applicable law.

2.3 Unless expressly agreed in writing, our Services do not include cleaning of the Premises after removal, dismantling of complex structures, disconnection of utilities, or removal of hazardous, restricted or prohibited materials.

2.4 We reserve the right to amend, suspend or withdraw specific Services, or to refuse a particular job, where it is unsafe, unlawful, impractical, or beyond our normal operational scope.

3. Booking Process

3.1 Bookings may be made by telephone, email, online form or other methods we make available from time to time.

3.2 When booking, the Customer must provide accurate and complete information, including but not limited to:

(a) the collection address and contact details;

(b) a fair and honest description of the type, volume and approximate weight of the waste;

(c) any access restrictions, parking limitations or special circumstances that may affect the Services.

3.3 We may provide an initial price estimate based on the information supplied. This estimate is not binding and may be adjusted on site if the actual waste volume, weight, type or access conditions differ from the description given at the time of booking.

3.4 A booking shall be considered confirmed only when we have accepted it and provided the Customer with a booking confirmation by verbal agreement or written communication.

3.5 We reserve the right to decline or cancel any booking at our discretion, including where we believe the job may pose safety risks, involve prohibited waste, or be otherwise unsuitable.

4. Pricing and Quotations

4.1 Our prices are generally based on a combination of factors, which may include the volume of waste, the weight, the type of materials, labour time, and any additional services requested.

4.2 Any quotation or estimate provided before attending the Premises is made in good faith but is subject to reassessment on arrival. We will confirm the final price before commencing the work wherever reasonably practicable.

4.3 Where access is difficult, where waste is not as described, or where extra labour, time, or equipment is required, additional charges may apply. We will explain such charges to the Customer before proceeding where possible.

4.4 All prices are stated in pounds sterling and, where applicable, include VAT or indicate whether VAT will be added, in accordance with current tax requirements.

5. Payments

5.1 Payment is due in full on completion of the Services, unless we have expressly agreed alternative payment terms in writing in advance.

5.2 We may accept payment by cash, debit or credit card, bank transfer, or other methods we specify. We do not accept payment by cheque unless agreed beforehand.

5.3 For commercial or repeat customers, we may, at our discretion, agree to invoice with specified payment terms. If such terms are agreed, payment must be made in accordance with the invoice. Late payment may incur interest and administration charges in line with applicable UK legislation governing late payments.

5.4 We reserve the right to withhold or suspend Services where payment is overdue, and to recover any reasonable costs incurred in pursuing unpaid sums, including legal and debt recovery costs.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by contacting us as soon as possible and providing the booking details.

6.2 Where a booking is cancelled by the Customer with sufficient notice, ordinarily at least 24 hours before the agreed arrival time, no cancellation fee may be charged. We reserve the right to specify or update our minimum notice period from time to time.

6.3 If the Customer cancels with short notice, fails to provide access, is not present without prior agreement, or the job cannot proceed due to incomplete or inaccurate information, we may charge a reasonable cancellation fee or call-out charge to cover our costs.

6.4 We may cancel or rearrange a booking where circumstances beyond our control occur, including but not limited to vehicle breakdown, severe weather, staff illness, traffic disruptions, or safety concerns. In such cases, we will use reasonable endeavours to inform the Customer and agree an alternative date or time. We shall not be liable for any loss arising from such cancellations or delays, subject to section 10.

7. Customer Responsibilities

7.1 The Customer is responsible for ensuring that we have safe, lawful and reasonable access to the Premises, including suitable parking arrangements for our vehicle and the ability to load waste without unnecessary risk.

7.2 The Customer must ensure that the waste to be removed is clearly identified and, where appropriate, segregated from items that are not to be taken. We accept no responsibility for removing items that were not intended to be discarded if they were not clearly separated or identified.

7.3 The Customer warrants that they have the authority, ownership or appropriate consent to request the removal of the waste from the Premises. The Customer shall indemnify us against any claim made by a third party alleging unauthorised removal.

7.4 The Customer must not request us to remove any items that are unlawful to handle, transport or dispose of, or that are otherwise prohibited under these Terms and Conditions or relevant regulations.

8. Waste Types and Prohibited Materials

8.1 We operate in accordance with UK waste regulations and our waste carrier obligations. Certain materials cannot be accepted or require special handling and additional charges.

8.2 Prohibited or restricted materials may include, without limitation, asbestos, clinical or medical waste, chemicals, solvents, oils, gas bottles, corrosive or explosive materials, radioactive materials, and other hazardous substances as defined by applicable law.

8.3 If such items are discovered during the course of providing the Services, we may refuse to collect them, or suspend the work until a safe and lawful solution is agreed. Additional charges may apply for any delay, extra labour, or specialist disposal required.

8.4 The Customer shall be solely responsible for any consequences arising from misdescribing or concealing hazardous or prohibited waste, and shall indemnify us for all costs, losses, damages or penalties incurred as a result.

9. Performance of the Services

9.1 We will use reasonable care and skill in performing the Services and will make reasonable efforts to carry out the Services at the agreed date and time or within a reasonable window around that time.

9.2 Times for attendance are approximate and may be affected by traffic, operational issues, or other factors beyond our control. Time is not of the essence unless expressly agreed in writing.

9.3 Our staff will determine the safest and most practical method of removing waste from the Premises. We may decline to undertake any task that, in our opinion, presents unacceptable risk to people, property or the environment.

9.4 The Customer acknowledges that some minor scuffs or marks may be unavoidable when removing large or heavy items from confined or difficult spaces. We will exercise reasonable care to minimise any such impact but cannot guarantee that it will be entirely avoided.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot lawfully be limited or excluded under UK law.

10.2 Subject to clause 10.1, we shall not be liable for:

(a) any loss of profit, revenue, business, contracts, goodwill, or anticipated savings;

(b) any indirect or consequential loss or damage, howsoever arising;

(c) any loss or damage resulting from inaccurate information provided by the Customer, failure to grant proper access, or failure to identify items not meant to be removed.

10.3 Subject to clause 10.1, our total aggregate liability to the Customer in respect of all claims arising out of or in connection with the Services, whether in contract, tort, negligence or otherwise, shall be limited to the total price paid or payable by the Customer for the specific job giving rise to the claim.

10.4 If accidental damage is caused to the Premises as a direct result of our negligence, the Customer must notify us in writing as soon as reasonably practicable and, in any event, within a reasonable period after becoming aware of the damage. We shall be given a reasonable opportunity to inspect and, where appropriate, remedy the damage or reach a settlement.

11. Waste Transfer and Environmental Compliance

11.1 We are committed to responsible waste management and comply with applicable UK waste carrier, transport and disposal regulations.

11.2 Once waste has been loaded onto our vehicle and payment has been made where due, ownership of that waste transfers to us or to our authorised subcontractors for the purpose of lawful treatment, recovery, recycling or disposal.

11.3 We will take reasonable steps to ensure waste is transferred only to authorised facilities. However, we do not guarantee that any particular item will be recycled, reused or disposed of in a specific manner unless expressly agreed.

11.4 Where required, we may issue a waste transfer note or similar documentation in accordance with current legal requirements. The Customer is responsible for keeping any such documents for the required retention period.

12. Subcontractors

12.1 We may, at our discretion, appoint subcontractors or third-party carriers to carry out all or part of the Services. In such cases, we will remain responsible for ensuring that the Services are performed in accordance with these Terms and Conditions, subject to the limitations of liability herein.

13. Complaints and Disputes

13.1 If the Customer is dissatisfied with any aspect of our Services, they should contact us as soon as possible with full details of the issue.

13.2 We will investigate complaints in a fair and timely manner and will seek to resolve disputes through communication and, where appropriate, reasonable remedial action.

13.3 Nothing in this section affects the Customer's statutory rights.

14. Data Protection and Privacy

14.1 We collect and process personal information necessary to administer bookings, provide Services and manage our business. This may include names, contact details, addresses and payment information.

14.2 We will handle personal data in accordance with applicable UK data protection legislation. We will not sell or disclose personal information to third parties except where required for service delivery, legal compliance, or with the Customer's consent.

15. Variation of Terms

15.1 We reserve the right to amend these Terms and Conditions from time to time. Updated terms will apply to new bookings made after the date of publication of the revised version.

15.2 The Terms and Conditions in force at the time of booking will generally govern that booking, unless both parties agree otherwise in writing or a change is required by law.

16. Severability

16.1 If any provision or part-provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision or part-provision shall, to the extent required, be deemed deleted, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

17.1 These Terms and Conditions, together with any written quotation or agreement we issue, constitute the entire agreement between the Customer and Rubbish Removal Sutton in relation to the Services, and supersede any prior understandings or discussions.

18. Governing Law and Jurisdiction

18.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them, or with the provision of the Services, shall be governed by and construed in accordance with the laws of England and Wales.

18.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.
